About these terms
These terms apply when you use this website and when you join The Songai Africa early access list. By using the website or joining the list, you agree to them. If you don’t agree, please don’t use the website or join the list.
The website is run by Songai Media FZ-LLC, a company incorporated in the Emirate of Ras Al Khaimah, United Arab Emirates. Our registered office is SBAM0117, Compass Building, Al Shohada Road, Al Hamra Industrial Zone – Free Zone, Ras Al Khaimah, United Arab Emirates. In these terms, “we”, “us” and “our” mean Songai Media FZ-LLC, and “you” means the person using the website.
The early access list
- It’s free. Joining costs nothing and doesn’t commit you to buy or use anything.
- No guaranteed place. Joining doesn’t guarantee you access to the service, a place in any launch group or access by a particular date. We may invite people in stages, for example country by country.
- Plans can change. Launch dates, features, prices, supported countries and streaming platforms may change before launch. Until the service launches, nothing on this website is a promise.
- Leave any time. Unsubscribe from any email, or email us, and we’ll take you off the list.
Who can join
To join the list you must:
- be at least 18 years old, or the age of majority where you live if that’s higher
- sign up only for yourself, using your own name, email address and, if you share it, your own WhatsApp number
- give accurate information and keep it up to date
Creating, releasing and earning
This website describes a service we plan to launch. Nothing on it is an offer to provide music creation, distribution or royalty services, or to enter into any agreement with you.
- Separate terms. Creating music, releasing it and sharing in royalties will be covered by separate terms, including an artist agreement. They will set out who owns what, the rights you grant us, any fees and how royalties are calculated and paid. You’ll see them, along with all prices, before you pay or commit.
- No guaranteed earnings. Royalties depend on how often people actually listen, on platform reporting and deductions, and on your artist agreement. We can’t promise you’ll earn any particular amount, or anything at all.
- Platform acceptance. Each streaming platform decides whether to accept a release and where it is available. We can’t guarantee that any platform will accept or keep your music.
- Examples. Example tracks, screens, figures, names and photos on this website are for illustration only. They aren’t real artists or results, and the final service may look and work differently.
Using the website
Please use the website fairly and lawfully. In particular, don’t:
- sign up anyone else, or give false or misleading information
- create sign-ups in bulk or with bots, scripts or other automated tools
- try to break, overload, interfere with or get unauthorised access to the website, our systems or our providers’ systems
- copy, scrape or reuse the website’s content for commercial purposes without our written permission
- send us anything unlawful, harmful or offensive, or anything that infringes someone else’s rights
We may remove anyone from the list who breaks these terms.
Our content and brand
We or our licensors own the website and everything on it. This includes the text, design, graphics, patterns, photos, example audio, the mascot and The Songai and The Songai Africa names and logos. You may view the website and share links to it. You may not copy, change or reuse its content without our written permission.
Spotify, Apple Music and other platform names belong to their owners. We mention them only to describe where we plan to distribute music. This doesn’t mean they endorse, sponsor or partner with The Songai Africa.
Your ideas and feedback
We love hearing from you. If you send us ideas, suggestions or feedback about our services, you agree that we may use them to improve what we do, without paying you or owing you anything for them.
Please don’t send us songs, lyrics, recordings or other creative work before launch. Your rights in music you create with the service will be set out in the artist agreement.
Other websites
The website links to other websites, such as The Songai and our email provider’s pages. We don’t control other companies’ websites and aren’t responsible for their content or how they handle your information. Please read their terms and privacy policies.
Availability
We work hard to keep the website accurate, secure and available. We provide it “as is”, though, and can’t promise it will always be available, error-free or up to date. We may change, suspend or close the website or the early access list at any time, for example if launch plans change.
Our responsibility to you
The website and the early access list are free. To the extent the law allows:
- we aren’t liable for any indirect or consequential loss, or for any loss of profits, income, data, opportunity or goodwill, arising from your use of the website or the list
- our total liability to you in connection with the website and the list is limited to the amount you have paid us
Nothing in these terms limits liability that can’t be limited by law, such as liability for fraud, or for death or personal injury caused by negligence. Nothing in these terms affects your rights under the consumer protection laws of the country where you live.
Your privacy
Our Privacy Policy explains what information we collect when you use the website or join the list, how Brevo stores it for us and how we contact you by email and WhatsApp. It also explains your rights.
Changes to these terms
We may update these terms from time to time, and we’ll change the date at the top of the page when we do. If you keep using the website or stay on the list after a change, the updated terms apply. If a change significantly affects you, we’ll email you about it.
Law and disputes
These terms are governed by the laws of the Emirate of Ras Al Khaimah and the applicable federal laws of the United Arab Emirates. The courts of Ras Al Khaimah have exclusive jurisdiction over any dispute about these terms, the website or the list. This doesn’t remove any right you have under the consumer laws of the country where you live, including any right to bring a claim in your local courts.
If something goes wrong, please contact us first. Most problems can be sorted out quickly without a formal dispute.
